Please read these Terms of Service (“terms”,"terms and conditions","agreement") carefully before using the www.10dollar.tech website or services ("service") provided by 10 Dollar Tech ("us", "we", "our", “staff”, “personnel”, “employee”, “technician”, "10DT"). Your access to and use of the service is conditioned upon your acceptance of and compliance with these terms. These terms apply to all visitors, customers, users and others who wish to access or use the service. By accessing or using the service you agree to be bound by these terms. If you disagree with any part of the terms then you do not have permission to access our services.
By accepting support or service from us, you are representing that you are over the age of 18 and have the capacity and authority to bind yourself and your employer, as applicable, to the terms of service; and consenting on behalf of yourself and/or as an authorized representative of your employer, as applicable, to be bound by the following terms of service. If you do not agree to all of the terms of service, or do not represent the foregoing, you will not and may not receive services from 10 Dollar Tech. Remote access services are provided at your sole risk. When you initiate a service request with us, you not only guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your request for service.
This Agreement contains the entire agreement of the parties, and there are no other promises or conditions in any other agreement whether oral or written concerning the subject matter of this Agreement. This Agreement supersedes any prior written or oral agreements between the parties. Parties agree that any disputes related to this agreement shall be governed in all respects by and construed in accordance with the laws of the USA, state of California, county of Marin.
The failure of 10 Dollar Tech staff to exercise or enforce any right or provision of the terms shall not constitute a waiver of such right or provision. If any provision of the terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties" intentions as reflected in the provision and the other provisions of the terms remain in full force and effect.
Any reference to us, we, our, staff, personnel, employee, or technician refers to Ernest Rodrigues DBA 10 Dollar Tech.
"You"
"You" means you individually, any person, including any employer that you are acting on behalf of.
"Service" or “Services”
"Service" or “Services” means 10 Dollar Tech’s chat, email, and phone based computer support and consulting services as set forth on the 10 Dollar Tech web site. The services include but not limited to: virus diagnosis, virus removal, PC tune-up, device configuration , email account setup, software installation, printed setup, printer support, general computer trouble shooting services, and consulting services. The scope of the services is subject to change without notice, and 10 Dollar Tech may discontinue or modify the services in its sole discretion. "Software" means any software used by 10 Dollar Tech in connection with the Services.
10 Dollar Tech provides expert technical support services for a vast array of electronic hardware, software, and peripheral products from various third-party companies. Unless explicitly specified, 10 Dollar Tech has no association with these third-party companies. Please contact the appropriate company for warranties and acceptable use related to their products. Ten Dollar Tech is not responsible for any action, changes, or modifications made that may void any third-party hardware or software warranty. We suggest that all customers contact their hardware or software manufacturer for support services if available prior to seeking support from us. These third-party companies may also provide technical support.
10 Dollar Tech provides on demand support services. Although we provide customers with the ability to specify their preferred availability, we do not guarantee that we will be able to accommodate any such request. 10 Dollar Tech is not responsible for loss of income, or productivity associated with not meeting the customers preferred availability time.
You authorize 10 Dollar Tech to configure your computer or device and delete the files that we deems unnecessary to a computer's operation. You give 10 Dollar Tech permission to alter the registry of any computer receiving the services as needed to provide the services.
10 Dollar Tech will only perform and provide computer services, repairs, upgrades, configuration, and consultation services as requested by the customer. Our goal is to provide the highest quality of service and support, but specific results cannot be guaranteed. There may be circumstances under which your computer, device, or peripheral can not be repaired remotely. You understand that in the process of working on your computer equipment, there is a potential for data loss. You agree that you have made the necessary backups of your data so that, in the event of such loss, the data can be restored. 10 Dollar Tech will not be responsible for data loss nor be responsible for restoring lost data. At request of the customer, 10 Dollar Tech will back up data for an additional fee prior to providing technical assistance. Windows and program files folders will not be backed up without a specific written request from the customer. 10 Dollar Tech will not be held responsible for corrupt operating system or applications. 10 Dollar Tech will not be held responsible for any issues that may occur during a support or consulting session.10 Dollar Tech technicians are 10 Dollar Tech certified technicians. However, they may or may not have any third party certification, unless expressly specified via our website or through any other means. You authorize the technician(s) providing the service or repair to install anti-virus and any other necessary software on your computer to perform required services. All repair software will be deleted / uninstalled upon completion of the service.
All remote repair services are subject to the terms in this agreement. The ability for 10 Dollar Tech to remotely access your computer significantly enhances our ability to resolve your technical issue quickly. You understand that by requesting such assistance, you will be providing 10 Dollar Tech’s, personnel with access to and control of your computer. In addition, you may be providing 10 Dollar Tech’s personnel with access to files that reside on your computer. We recommend for your security and privacy that you exit any applications you have open that is displaying content such as personal or confidential information before allowing 10 Dollar Tech's staff to initiate a remote support session. 10 Dollar Tech further recommends that you remain seated at or near your device throughout the entire remote session.
10 Dollar Techs business hours of operation are from 8:00AM (PST) to 8:00PM (PST). These hours of operation are subject to change at the sole discretion of 10 Dollar tech and without prior notice.
At the current state of technology, it is impossible to guarantee that data communication via the Internet or wireless will be completely safe, free of faults and/or available at all times. 10 Dollar Tech therefore does not guarantee the availability of its service at all times and shall not be liable for disappointed trust of the user in its faultless functioning. 10 Dollar Tech also does not guarantee the functionality of ticket submission system, merchant services, or remote access tool providers. 10 Dollar Tech is not liable for any failure or delay caused by problems with Internet connections. By using our service you agree to release from liability any entity, provider, or merchant utilized by 10 Dollar Tech as a tool to provide you with service.
10 Dollar Tech services are subject to change without notice. The services do not cover restoration services, on site repair services, lost or expected profits, lost or corrupted data, lost or deleted work, or lost or damaged personal files. 10 Dollar Tech does not guarantee against the loss of any file, information, or data. Customer is solely responsible for backing up and safely storing its data, information, and files prior to initiating request for service.
10 Dollar Techs affordable support model is based on 15 minute incremental support sessions. To allow us to continue to provide support services at such a low rate we must limit support sessions to 15 minutes. Service fees will be calculated in 15 minute increments, and carry a minimum $10 charge per 15 minutes of support or consultation time. An estimate of cost for work will be provided before providing service. In some cases the length of time required to provide support or consulting services cannot be predicted. Estimates are not guaranteed. If additional support fees are required you will be notified by a staff member at or near the end of your support or consultation session. Sessions that exceed the initial15 minute support barrier may be extended free of charge solely at the discretion of a 10 Dollar Tech staff members. Your decision to continue or stop will be honored by our staff. If you choose to continue with support beyond the initial 15 minute session, you will incur a charge of $10 fee per additional 15 minutes of support or consulting time. Opting to extend a support session may result in more than one charge on your credit or bank card. You acknowledge and agree that neither 10 Dollar Tech nor any 10 Dollar Tech affiliated company will have any liability whatsoever for any non-sufficient funds or other charges incurred by you as a result of such attempts to charge, and/or place holds on, your credit card. 10 Dollar Tech does not prorate any purchased support time blocks (15 minutes). 10DT reserves the right to change their support or consulting service pricing at any time without prior notification.
If our technical support staff has resolved one or more issues, provide any instruction, or any consultation services whatsoever, you will not be refunded. It’s at the sole discretion of our staff and on a case by case basis as to whether sufficient support has been provided.
10 Dollar Tech is not accountable for any content related to third party companies that is provided on or as links though this website. 10 Dollar Tech has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party web sites or services. We do not warrant the offerings of any of these entities/individuals or their websites. You acknowledge and agree that 10 Dollar Tech shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such third party web sites or services. The use of such content and third party products and services is expressly at your own risk and you bear any and all associated responsibility. Please carefully review the privacy policies and terms of service of all such sites prior to usage. You in every way assume the risk of any usage of such third party sites. 10 Dollar Tech is not responsible for any changes or updates that are made as the result of accessing links through our site or sites accessed while providing service.
ANY USE OF SOFTWARE WHILE WE PROVIDE YOU WITH SERVICE IS AT SUBSCRBER'S OWN RISK. THE SOFTWARE MAY CONTAIN BUGS, ERRORS, AND OTHER PROBLEMS THAT COULD CAUSE SYSTEM OR OTHER FAILURES AND DATA LOSS. 10 DOLLAR TECH DOES NOT WARRANT THE PERFORMANCE OF ANY SOFTWARE AND DOES NOT WARRANT THAT ANY SOFTWARE WILL OPERATE SUBSTANTIALLY IN ACCORDANCE WITH THE DOCUMENTATION ACCOMPANYING THE SOFTWARE.
For the purposes of identifying a device (work stations, laptop, tablet, mobile device, etc) under the agreement, 10 Dollar Tech shall, in the course of remote access and within the scope of the purpose of the agreement, may store the IP and MAC addresses of the respective device temporarily for the purposes of transmission of the remote access initiated by the Customer. 10 Dollar Tech shall also store data on the type of processor, screen resolution, graphics card, operating system and potentially other technical data of the device requiring support.
The customer shall prevent the unauthorized access of third parties to protected their data by taking appropriate measures. The customer shall scan its data and information for viruses and other damaging components prior to support request submission and shall use a state-of-the-art anti-virus program for this purpose. In the event of a culpable breach against the above provisions the customer shall be liable for the resulting damage; the Customer shall indemnify 10 Dollar Tech against all claims of third parties which are due to such breach and shall compensate 10 Dollar Tech for any costs which arise due to potential infringements of rights.
Customer is responsible for providing correct information when submitting a support or consulting request ticket. 10 Dollar Tech stores the submitted data as well as technical notes regarding the methods used by 10 Dollar Tech staff members during service or consultation sessions. You are exclusively responsible for the content of all ticket submission data, including any violation and defiance of any law(s) contained within such submissions, copyright, fraud, privacy, and other regulations and laws. You fully agree to hold us harmless and defend us and indemnify us from any civil actions filed or threatened to be filed by any third party or entity who establishes that your submissions support a legal cause of action. We also reserve the right to publish the contents of emails that you send us, removing personally identifying information prior to publication. Examples would be letters of praise, testimonials, thank you notes and so forth.
Inbound and outbound calls may be recorded for quality assurance and training purposes. If you do not wish to be recorded please notify the 10 Dollar Tech support representative that you’re working with.
10 Dollar Tech accepts credit card payments. We don't store credit card information for any customer. If you wish to have 10 Dollar Tech provide any service made available through our website, you may be asked to supply certain information relevant to your purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your contact information.
You represent and warrant that: you have the legal right to use any credit card(s) or other payment method(s) in connection with any purchase; and that the information you supply to us is true, correct and complete. The service may employ the use of third party services for the purpose of facilitating payment and the completion of purchases. By submitting your information, you grant us the right to provide the information to these third-parties.
You hereby authorize 10 Dollar Tech’s third-party service to charge and/or place a hold on your credit card with respect to any requested support services. You authorize the issuer of the credit card to pay any amounts described herein without requiring a signed receipt, and you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay any amounts described herein without requiring a signed receipt, and you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay all such amounts. You authorize 10 Dollar Tech and/or any other company who bills products or services, or acts as billing agent for 10 Dollar Tech to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your credit card until such amounts are paid in full. If you provide a debit card number, instead of a credit card number, you authorize all charges described herein to be applied to such debit card. When payment is made by credit card or debit card, payment will also be subject to the terms and conditions established by the credit or debit card issuer.
Credit card data is not stored by 10 Dollar Tech, but collected and processed through our website by a third-party vendor.
10 Dollar Tech in our sole discretion reserves the right to refuse, terminate, conclude, or cancel your service request at any time without notice for any reason that we consider fit. Some reasons may include but not limited to: errors in ticket submission, incomplete ticket submission, abusive conduct towards staff members, or other reasons. We reserve the right to refuse or cancel your support request if fraud or an unauthorized or illegal transaction is suspected. We therefore reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time.
Every effort has been made to ensure the accuracy of all information on our website. 10 Dollar Tech makes no warranty, express or implied, with respect to the accuracy of the information, including prices, testimonials, product images or advertising. All 10 Dollar Tech pricing is current at the time of publication and is subject to change without notice. The content provided on or through the 10 Dollar Tech website is provided”as is” and “as available” basis.
